An Interesting Answer

Previously, I posted about the district claiming immunity from having to pay court costs in a lawsuit they lose… see this post for details.

While this is eminently debatable (and no doubt will be debated in court — at, what, $400/hour billed to the district?), there is also a new twist…

Larry D. Bishop is a named plaintiff in the restraining order request.  Larry D. Bishop as a person, apparently — not as the district manager of Woodmen Hills Metropolitan District…

And as such, apparently can be held liable, as this court filing requests.

I am not clear on the rules about this, but If this is correct, Larry D. Bishop the defendant cannot be represented by the district’s attorneys…nor is he covered by the district’s insurance.

Told you it was interesting.  :)

Still, I’m pretty sure he can afford it — $2,948.75 comes to a little over 8 5 days of his salary.

Update 23 Dec 2009

Wow, lots of questions about that last line!

OK, let’s walk through the calculations.

  1. The published salary of the Woodmen Hills Metropolitan District manger is $130,000/year (see this document);
  2. There are approximately 52 weeks per year;
  3. The average work week is 40 hours/week;
  4. 52 weeks x 40 hours/week is approximately 2080 work-hours each year.

Thus, calculating out the district manager hourly salary:  $130,000 / 2080 = $62.50 per hour.

Finally, $2948.75 / $62.50 = 47.18 hours;  thus, Mr. Bishop will earn this amount in 5.89 days.

Now, this is gross, not net;  taxes will take a bite out of that.  However, this also does not factor in holidays, vacation days, sick days, or other compensation, so it’s probably not that far off.

Also, in fairness, I would imagine Mr. Bishop puts in more than 40 hours a week — but this begs the question:  is he salaried, or hourly?

Come to think of it, what about all employees of the district….salaried, or hourly?  What is the district’s policy on overtime?  Who can approve?
