You will recall that I submitted a letter to the board on the 18th of June, asking some specific questions. You can read this letter by clicking here, or in the links section under “Other Documents”. Today I received the answer from the district. You can read it by clicking here, or in the links section. Not much there, huh? Of the 6 questions and 2 actions in my letter, one question was answered. I have gone back to the board and asked for clarification…we’ll see what we get.

Jan Pizzi provided me a personal response to my request. You can read it by clicking here. While not what I was looking for, I do understand there is a lot of stuff going on; so, we’ll wait a bit, and see what happens. I have, however, done some more digging — it would appear the whole arrangement regarding covenant enforcement fees is illegal, by CRS 32-1-1004(8)(b):
The board of a metropolitan district shall have the power to furnish covenant enforcement and design review services pursuant to this subsection (8) only if the revenues used to furnish such services are derived from the area in which the service is furnished.
I doubt the district has fenced off the funds for covenant enforcement, which means that all funds paid into the district are “comingled”….and that means that the funds you pay for water, wastewater, parks, recreation, streetlights, etc were used for covenant enforcement. Why do I think this is illegal? The “area in which the service is furnished” is filings 1-9. I live in filing 11, outside this area…yet since the funds are comingled, I am paying for a service outside my area. So is Paintbrush Hills…so is Safeway….so are all other customers of WHMD. I reemphasize: WHMD IS NOT WOODMEN HILLS. WHMD serves many areas outside of Woodmen Hills. WHMD is a metropolitan district that provides water, wastewater, parks, and recreation. They are no different than Colorado Springs Utilities in that regard.



I was at the meeting when the board promised Kathy Wennen, Connie Dolbach and some Henry guy.
The board was forced to do what they wanted them to do against their will,
I was there. Brad Rutan didn’t want to hear it anymore. Bob Sabota was tired of hearing it.
Jennifer Barber was trying to appease the whiners. and the older fella was tired of wasting so much time on the matter. They just caved to the covenant communists and gave them start up money. I was at one of the meetings. I can tell you I told Kathy and Henry your gonna cost us millions when this is over.
Janice Pizzi was all for it. clapping all the way. I told the board that forcing covenants was wrong.
No one listened. Kathy kept spouting its the law its the law. The new Law allows us to do this.
Kathy’s premise (Idea) was doing covenants would enhance and help retain home values. Boy were they wrong. Housing bust did more damage. Now who’s Kathy gonna blame for low housing values this time. A 140.00 monthly water bill will deter potential new home buyers during a bleak housing crisis. they can go across the street for half or down the road for about a third. Now if your the consumer and looking for a new home on a budget, where do you think your gonna look. Banking 101. Just for the record how many empty houses are in WHMD. I know, I just want clarification.
